Trump Unveils 150-Day 10% Global Tariff After Supreme Court Blocks Emergency Trade Duties

U.S. President Donald Trump on Friday announced a temporary 10% global tariff that will remain in effect for 150 days, replacing the sweeping emergency trade duties recently struck down by the Supreme Court of the United States.

The new tariff will be implemented under Section 122 of the Trade Act of 1974, a provision that allows the president to impose duties of up to 15% for 150 days to address serious balance-of-payments issues. Unlike other trade enforcement mechanisms, Section 122 does not require extensive investigations or lengthy procedural steps, enabling quicker action.

The move comes shortly after the Supreme Court invalidated Trumpโ€™s earlier global tariffs, which had been imposed under the International Emergency Economic Powers Act. The court ruled that the administration exceeded its authority under that statute, effectively blocking the broader emergency-based trade measures.

Speaking at a White House press briefing alongside Commerce Secretary Howard Lutnick, U.S. Trade Representative Jamieson Greer, and Solicitor General D. John Sauer, Trump expressed confidence in alternative legal tools available to his administration.

โ€œWe have alternatives, great alternatives,โ€ Trump said. โ€œWeโ€™ll take in more money and weโ€™ll be a lot stronger for it.โ€

In addition to the temporary tariff, the president announced the launch of several Section 301 investigations targeting what he described as unfair trade practices by foreign governments and corporations. However, Section 301 probes typically take months to complete, while the 10% tariff introduced under Section 122 authority can only remain in effect for a maximum of 150 days.

The announcement underscores the administrationโ€™s determination to maintain its hardline trade policy approach despite the legal setback, signaling that the White House is prepared to pursue other statutory routes to advance its economic agenda.
