Oyo Govt faces legal action over Agodi Gardens conversion

Ibadan-based lawyer, Mr. Adeniyi Muhammed Uthman, has taken legal action against the Oyo State Government for converting a significant portion of the over 40-year-old Agodi Botanical Garden into a housing estate.

Originally established for flood control and nature preservation, the garden underwent redevelopment in 2014/2015 for recreation during the late Abiola Ajimobi administration. However, the current government, led by Governor Seyi Makinde, has initiated the redevelopment of more than 40 hectares for a housing estate, citing concerns about criminal hideouts and the need for additional housing.

Uthman, in his lawsuit, seeks a declaration that Agodi Gardens is a vital tourist and recreational facility, forming a core socio-cultural heritage of Ibadan and Oyo State.

He contends that the conversion without regard to its history constitutes a flagrant abuse of power and is repugnant to natural justice.

The lawyer further requests an order nullifying the conversion, stating that it is void and an injunction preventing further interference or destruction of Agodi Gardens. The controversy surrounding Governor Makinde’s decision has sparked criticism, with concerns raised by the elite about environmental impact and the destruction of historical heritage.

Governor Makinde, however, clarified that the housing estate construction would not significantly affect the existing trees or the Agodi Garden developed by the Ajimobi administration. He expressed the government’s intention to upgrade Agodi Garden into a world-class recreation centre.

The hearing for this legal challenge is set to commence on January 19, with the Oyo State Government, Attorney General, Commissioner for Justice, Commissioner for Lands, Housing and Urban Development, and Commissioner for Environment and Natural Resources listed as defendants.
